Prohibition of Possession of Firearms and Carrying of Concealed Weapons

It is the policy of Maryville University of Saint Louis to prohibit the possession of firearms and the carrying of concealed weapons on University property, including the Sunset Hills Center and Lake St. Louis Center.

This policy also applies to students and employees of the University during their attendance at off-campus, University-sponsored activities. All individuals, whether licensed or not, are prohibited from possessing firearms or carrying concealed weapons on University property at any time unless they are licensed law enforcement officers who are required to carry a firearm

Definitions

  • “Concealed” means to be carried on or about a person or in a vehicle in such a manner as to not be readily visible.
  • “Firearm” means (i) any weapon that is designed or adapted to propel a projectile by the action of an explosive, and shall include any rifle, shotgun or handgun; and (ii) any explosive and explosive device, except where such device is being used in connection with authorized construction or maintenance activities on campus property. This policy applies to all firearms, whether or not loaded and whether or not capable in fact of being fired or detonated.
  • “Weapons” includes any device that is designed to be used, or which is intended by the person in possession of the device to be used, to inflict serious bodily harm upon individuals or cause damage to property. Examples of weapons are firearms, knives, brass knuckles, and martial arts devices such as batons and numchuks. An ordinary folding pocketknife with no blade more than four inches in length ordinarily will not be considered a weapon.

Application of Policy

  • If an employee violates this policy, it will be grounds for immediate dismissal from the University with no recourse through the Grievance Procedure(s).
  • If a student violates this policy the student will be disciplined in adherence to the University policies
  • Visitors to the University who violate the policy will be requested to leave University property immediately, and may be subject to ban from University property.

Where appropriate the University may refer the matter to law enforcement authorities for investigation and prosecution.

Inspection

The University always endeavors to respect the privacy of its students and employees. The safety and physical well-being of the members of the University community, however, must always be our priority. Accordingly, in connection with the enforcement of this policy:

  • The University reserves the right to conduct an inspection reasonably calculated to discover the presence of firearms or concealed weapons of an employee’s person, office, desk, vehicle and personal items (e.g., purse, backpack, coat or other outerwear, parcels or containers) at any time without prior notice. If an employee fails to cooperate with any such inspection the employee will be subject to disciplinary action up to and including termination.
  • The University reserves the right to conduct an inspection reasonably calculated to discover the presence of firearms or concealed weapons of a student’s person, residence hall room or University-owned apartment, vehicle and personal items at any time without prior notice. If a student fails to cooperate with any such inspection the student will be subject to disciplinary action up to and including expulsion from the University.

Exceptions to Policy

The President may grant written exceptions to this policy for good reason if the President is satisfied that the safety of the University community will not be compromised. Such reasons may include, but are not limited to, legitimate academic activities involving the display of weapons; carrying of weapons by persons employed to insure the security of persons on University property; or professional fireworks displays involving explosive devices.

Other Threatening Behavior

Nothing in this policy shall be construed to prohibit the University from ordering a student or employee to desist from engaging in any behavior that could reasonably be expected to cause other persons to be concerned about their personal safety or the safety of other persons or property, whether or not such behavior is described in this policy, or to prevent the University from initiating appropriate disciplinary action against an employee or student engaging in such behavior.
